Why the 25-Year Rule Matters
For most JDM enthusiasts, the most important import rule is the 25-Year Rule. In simple terms, a vehicle that is at least 25 years old, based on its month and year of manufacture, can generally be imported without needing to prove that it complies with all current Federal Motor Vehicle Safety Standards.
That is why build month matters so much. A car built in May 2001 becomes 25 years old in May 2026. A car built in December 2001 does not become 25 years old until December 2026.
This is also why two cars from the same model year can have different import eligibility dates. The key is not just the model year. The key is the actual production month and year shown on the vehicle’s documentation.
What If the Car Is Newer Than 25 Years Old?
This is where things get much more difficult.
If a vehicle is less than 25 years old, was not originally built for the U.S. market, and does not have the original manufacturer’s certification label showing that it complies with all applicable U.S. safety standards, it generally cannot be permanently imported like a normal 25-year-old vehicle.
In some cases, a newer nonconforming vehicle may be imported through a Registered Importer, often called an RI. But that is not a simple workaround. The vehicle usually has to be determined eligible by NHTSA, the RI has to bring the vehicle into compliance with applicable safety standards, and a bond is required during the process.
In practice, this means newer non-U.S.-market cars are often:
- Limited to specific make, model, and model year eligibility decisions
- Expensive to petition, test, modify, and document
- Dependent on whether the vehicle can realistically be brought into compliance
- Not practical for many enthusiast vehicles
So yes, importing certain newer vehicles can sometimes be possible, but it is usually difficult, expensive, and very limited. For most JDM buyers, the 25-year path is the realistic legal route.
DOT, EPA, and Customs: Three Separate Parts of the Process
A legal vehicle import involves more than one government agency. A car must be handled correctly for DOT/NHTSA safety requirements, EPA emissions requirements, and U.S. Customs and Border Protection.
At the time of import, vehicles typically require documents such as:
